E-STAT 1996 EDUCATIONAL INSTITUTION LICENCE AGREEMENT The Government of Canada (Statistics Canada) is the owner or authorized licensee of all intellectual property rights (including copyright) in the data product referred to as E-STAT. In consideration of the payment of the requisite fee, Statistics Canada grants the educational institution identified below a non-exclusive, non-assignable and non-transferable licence to use the data product subject to the terms below. The licence is not a sale of any or all of the owner's rights. This data product may onlyt be used by authorized users which means members of the institution's staff and volunteers or registered students. This data product is supplied strictly for educational, non-commercial purposes. The data product shall not be copied in its entirety. No copy of the software contained in the data product may be made except for those portions, if any, supplied on floppy diskette which may be copied for backup purposes. Selected extracts of data, graphics or text from the data product may be reproduced or translated into another language or adapted for the educational and non-commercial purposes of the institution. Statistics Canada shall be acknowledged as the source in any extracts being published. The data product supplied under this agreement shall at all times remain under the control of the institution. It may not be sold, rented, leased, lent, sub-licensed or transferred to any other institution or organization, and may not be traded or exchanged for any other product or service. The data product may not be used for the personal or commercial gain of any authorized user, nor to develop or derive for sale any other data product that incorporates or uses any part of the data product. The data product may not be transferred to nor stored in an electronic network unless you have selected the network option and paid additional fees. This data product is provided "as-is", and the owner makes no warranty, either express or implied, including but not limited to, warranties of merchantability and fitness for a particular purpose. In no event will the owner be liable for any indirect, special, consequential or other damages however caused resulting from the use of the product. A licence administrator [Carole R. Moore] shall be identified within the educational institution, and will be responsible for the management of the data product and communication of these terms and conditions to all authorized users. The administrator will ensure that the use of this data product complies with these terms and seek prior written permission from Statistics Canada for any uses not permitted or not specified in this agreement. Failure to comply with any terms of this agreement will result in termination, without notice, of this agreement.
